Mutual Agreement!

The majority of sites call this part their “terms and conditions of business”! We prefer a less formal and friendlier approach. After all, we will be working together with the aim of forming a mutually beneficial long term relationship. What this page does is clearly sets out what is expected of us, the service providers, and you, the customer. There is no small print on this page and it is written in plain English.

And so….

A contract is formed between us by you giving us some money, and in return for that money we provide you with agreed services to the best of our abilities. Under UK law in order to be valid a contract must be fair to both parties. This site is based in the UK and operates under UK law so this basic principle of fairness will be applied throughout!

So far so good! So what exactly do you get for your money?

We will set up a professional standard WordPress site and blog to include:

  • Site title and basic site settings
  • Site appearance and theme customisation
  • Import and use of images (up to 25), blank pages (up to 10) ready for your content and with your choice of titles
  • Training and support in adding and formatting content for those pages, 5 blank blog posts with your choice of titles with training and support in adding and formatting content
  • Ongoing support and training as you gain confidence and experience managing content

3rd party plugins

Plugins and services will be subject to the terms and conditions of the developer. We can install the following plugins as part of your account set up – we will fully discuss everything with you beforehand:

  • Securi Security: The Sucuri plugin provides the website owner the best Activity Auditing, SiteCheck Remote Malware Scanning, Effective Security Hardening and Post-Hack features. SiteCheck will check for malware, spam, blacklisting and other security issues like .htaccess redirects, hidden eval code, etc. The best thing about it is it’s completely free
  • Akismet protects your blog from spammers. Its free for personal sites but is a paid service for business users. Unless you really want people commenting on your blog posts however we suggest disabling comments on your site
  • Cookie consent check this page to see why this is needed: https://www.cookielaw.org/the-cookie-law/
  • Contact form 7 is a very easy to use and versatile contact form

These plugins combined will ensure that you have a robust and functional site and blog.

Care should be taken when selecting plugins and services for use with WordPress. Additional specialist plugins may be installed on a per project basis, fees to be agreed in advance

Hosting:

Hosting via NetSkiver is provided via TSOHOST https://www.tsohost.com/  and services are provided subject to their terms and conditions. TSOHOST offer 24/7 support. NetSkiver will only work with sites hosted via our prefered service provider or providers. Students enrolling in 2017 & 2018 benefit from ongoing hosting for a fixed price of £30 P/A for 5 years. You can request to have your website transferred away to another hosting provider of your choice at any time. Once a site is transferred away NetSkiver will cease to provide support.

Domain names:

Domain names registered by NetSkiver on your behalf will be registered via our account with GoDaddy https://uk.godaddy.com/ – GoDaddy is one of the main domain name registrars and services are subject to their terms and conditions. All domain name registration are charged at cost plus £1.95 to cover PayPal & Banking fees. You can of course register your own domain name and change the settings so that it opens the site that we will be building for you. If you prefer to do this we recommend that you open your own GoDaddy account, its free, and register your own domain name via them.

You can request to have your domain name transferred away to another registrar of your choice at any time. You will be responsible for meeting any domain name transfer costs plus a £10 fee to NetSkiver. This £10 covers our time spent arranging the transfer. You are responsible for meeting any transfer fees payable to your chosen registrar.

Data protection:

We are registered with the Data Protection Office, No. ZA234196, and are committed to protecting your privacy and keeping your personal information secure. We will not disclose your details to any person, unless you have given your consent or we are compelled to do so by law, or in response to a valid, legally compliant request by any law enforcement agency or government authority

Time to set up:

From the time you purchase a website from us we will fly into action to set your site up as quickly as possible. It is possible to register a new domain name and have a new site set up within 24 hours. Our record was under 3 hours!!!

There can be delays that are outside our control, especially with changing settings on domain names so that they point towards the site we are building for you. Although the setting are often activated and working fully within hours there are some occasions, depending on demand, where this has taken up to 48 hours.

We will, however, work to set your site up as quickly as possible. being self-employed we don’t have regular hours so it is not unusual to find us beavering away at 3am in the morning, over weekends or getting ahead of work over a bank holiday weekend while everyone else is on a break!

Bearing in mind the above our commitment to you is to set your site up within 5 working days.

E-Commerce:

If you have items to sell via your website a logical choice for an e-commerce plugin is woo-commerce. Both word-press and woo-commerce are owned by the same company. Woo, as its called, is a very popular sales platform used by millions. Its easy to install and there are many YouTube videos that can guide you through set up.

Alternatively we can agree a project fee to help you set it up – this can vary from setting up the basics to get you started to setting up your shop for you

Keep it legal:

You remain responsible for the content of your site. By using our services you agree that will not to post illegal content and that you will respect copyright by not using other people’s material or work without first receiving their permission. In the unlikely event that we discover that you are not keeping it legal then we reserve the right to terminate our contract without prejudice by giving you 30 days notice. This will give you the opportunity to find a new hosting provider and transfer your site and domain name away.

Disclaimer and limits of liability:

NetSkiver undertakes to carry out the service to you with a reasonable level of care and skill. Any liability under any agreement between you and NetSkiver shall be limited to any sums paid by you to us minus any non-refundable services, specifically but not limited to domain name registration (See above). As far as permitted by law, NetSkiver shall not be liable to any person for losses or damages that were not reasonably foreseeable and that were not caused by any breach on our part. We shall not be liable to any person for any direct or indirect loss or damage as a result of circumstances outside of our control. Any liability that does arise will be limited to fee’s paid. NetSkiver is a UK based service provider and all transactions and agreements are subject to UK law.

NetSkiver operates on a sole trader basis. Additional support is provided by another experienced WordPress developer with whose standard of work we are familiar
